'); // --> In a wrongful death lawsuit it is alleged that the decedent (or person killed) was killed as the direct or indirect result of the negligence, actions, or other liability on the part of the defendant or defendants. And that the surviving beneficiaries or dependents are entitled to damages (usually monetary) as a direct result of the defendant’s actions. Interestingly, wrongful death lawsuits are not recognized under common law because it was believed that the claim died with the death of the victim and therefore the surviving family members of the victim could not file a wrongful death claim and collect damages from the person responsible for the victim’s death. This was seen as a legal injustice and the individual states have takes steps to enact some form of wrongful death claim. The general guidelines are the same in each state, but each has drafted a “wrongful death statute” that is unique to each state.
